Will of Ex-Commissioner William
McGovney, of Liberty Township.

In the name of the Benevolent Father of all, I, William McGovney, of Liberty Township, Adams County, Ohio, do make and publish this my last will and testament in manner and form following:

First, I desire all my debts and financial expenses, including a suitable monument at a cost of about $350, first paid.

Second, in addition to what I have already given to my two daughters, Mary E. Ellis and Louisa A. McDaniel, I give and bequeath to each of them $500 in money ; that all my personal effects of every kind are to be converted into money by my executor herein after appointed, and after payment of debts mentioned in item first, together with all expenses of administration and the legacies provided for in item two, the residue thereof is to be equally divided between my daughter, Mary E. Ellis and Louisa A. McDaniel, and my son, Samuel McGovney, in equal shares, deducting advancements that I have made to each of them for which I hold advancement receipts so as to make them equal in the residue to be divided among them.

Third, to my daughter, Isabella, I give and devise the farm on which I now reside, containing about 185 acres, known as the Lindsay farm ; also about 55 acres purchased by me of Wm. A. Gardner save and except two acres off of the north end thereof upon this condition, however, that she doth board, care and provide for my son, Newton, in sickness and in health as long as he shall live, and if she thus maintains my said son to the time of his death and pay to my daughter, Eleanora Fulton, the sum of $800 in four equal annual payments after my death without interest, then she is to have the fee simple of said farms, but it is understood that the maintenance of my said son during his life and the payment of the said $800 to my said daughter, Eleanora Fulton, is to be a lien on said farm for the performance thereof, and if my son should outlive my said daughter Isabella, then if the children ...[unintelligible]...if any of them will take it upon themselves and perform the conditions required of their mother toward my said son, Newton, and my daughter, Eleanora Fulton, then and in that case the son or sons so complying shall have said farms in equal shares proportionate to their compliance with said conditions in fee simple.

Fourth, I give and devise to my son, John W. McGovney, my old homestead farm whereon he now resides, containing about 197 and three-quarters acres more or less ; also about twenty acres adjoining thereto on the northwest, ten acres of which I got of M. Wikoff and ten acres of Andrew Alexander ; also the two acres excepted off of the north and of the 55 acre tract in item three to have and to hold in fee simple.

Fifth, I hereby nominate and appoint my friend, W. F. Mahaffey, Executor of this my last will and testament, hereby revoking all former wills by me made, hereby empowering him to compromise and adjust all claims due and to sell at public or private sale any or all of my private chattle property and to perform all other duties required by the will, and I hereby further provide and direct that if any of my heirs or devisces under this will should become dissatisfied with my said will or any part thereof ands should go to law in any manner with the intention to revoke, set aside or change my said will in any manner, said party so going to law shall receive no part whatever of my estate, and his or her share shall go in equal parts to the other devisces and legatees herein.

In testimony whereof I have set my hand and seal this 5th day of January, 1891.

[SEAL]

WM. McGOVNEY

Signed, sealed and acknowledged by said W. McGovney at his last will and testament in out presence and signed by us in his presence and at his request.

HENRY SCOTT,
W. E. GARDNER.
